Heard learned counsel for both the parties.
This is an application under Section 151 of the Code of
Civil Procedure for allowing the applicant to withdraw the amount of Rs.10,95,890/- (rupees ten lakh ninety-five thousand eight hundred and
ninety) only deposited by the insurance company which is lying in fixed deposit.
Learned counsel appearing on behalf of the respondent, has
no objection to the same.
Accordingly, the Registry is directed to release the
deposited amount of Rs.10,95,890/- in favour of the applicant forthwith unconditionally as per procedure.
In view of above, the withdrawal application stands
allowed and disposed of.
