Mr. S. Lodh, learned counsel appearing for the petitioner has submitted that wrongly this petition has been filed before this court and as such, the petitioner would like to withdraw this petition with liberty reserved to file an appeal against the judgment and award where the petitioner could not contest the case properly.
The prayer stands allowed having liberty reserved to the petitioner to file an appropriate appeal and as such, the benefit under Section 14 of the Limitation Act will be available for the period which the petitioner has exhausted in prosecuting this revision petition.
Accordingly, this petition stands dismissed as withdrawn.
