Heard Mr. B. Debbarma, the learned counsel for the petitioner. Also heard Mr. R.C. Debnath, the learned Addl. Public Prosecutor appearing for the State.
This is an application under Section 439 Cr.P.C. filed by the petitioner namely, Sri Pranay Deb, for granting bail to the accused persons namely, (1) Sri Subir Dey, and (2) Sri Arabindu Dey, who have been detained in custody since 01.07.2017 in connection with Kamalpur Police Station case No.70 of 2017 under Sections 304-B/34 IPC.
With the assistance of the learned Addl. Public Prosecutor, I have carefully gone through the case diary as well as the postmortem report of the deceased.
After giving my anxious consideration to the prayer for bail as well as the submission of the learned Addl. Public Prosecutor, I am of the view that further detention of the accused persons in custody is no longer required.
Resultantly, both the accused shall be released on bail on executing a P.R. bond of ₹50,000/- (rupees fifty thousand) by each of them with one surety of the like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Kamalpur.
The application stands disposed of.
