Heard Mr. R. Dutta, the learned counsel for the applicant. Also heard Mr. S. Sarkar, the learned Public Prosecutor appearing for the State.

This is an application under Section 439 Cr. P.C filed by the applicant, Sri Bidhan Chandra Das for granting bail to the accused namely, Sri Juel Das who has been detained in custody since 24.03.2017 in connection with Case No. 2017 KDL 012 (Kadamtala PS Case No.12/2017) registered U/s 363/354/506/509 IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012 (POCSO) with subsequently added Section 376 IPC and Section 4 of the POCSO Act, 2012.

By this time, the accused has already been in custody for more than 50(fifty) days. On going through the Case Diary produced by the learned Public Prosecutor, particularly, the statement of the prosecutrix under Section 164 Cr. P.C and the FIR, I am of the view that this is not a fit case for further detention of the accused in custody.

In the result, the accused namely, Sri Juel Das shall be released on bail on his executing a P.R Bond of ₹50,000/(rupees fifty thousand) with one surety of the like amount to the satisfaction of the learned Sessions Judge, Dharmanagar.

Bail application is disposed of.
