Heard Mr. A.K. Bhowmik, learned senior counsel appearing for the petitioner as well as Mr. R.C. Debnath, learned Addl. P.P. appearing for the State who has produced the case diary in terms of the order dated 14.10.2016.

Mr. Bhowmik, learned senior counsel has reiterated his submission as made before this Court on 14.10.2016 that from the possession of the accused no counterfeit currency was received. As such, no charge can be maintained against the accused under Section 489B of the IPC. But Mr. Bhowmik, learned senior counsel has submitted without prejudice that at best the charge under Section 489C of the IPC is made out against the accused petitioner, if the version against the accused is believed.

Without any comment on that aspect of the matter, this Court while scrutinising the case diary has come across certain materials which may raise serious suspicion against the accused. Furthermore, Mr. Debnath, learned Addl. P.P. appearing for the State has submitted that the accused had been circulating the counterfeit currencies to the other accused persons and the police seized those counterfeit currencies by way of seizure list.

Having regard to all these aspects of the matter, the order dated 14.10.2016 is made absolute subject to the condition that the accused shall not leave Damcherra Police Station area without prior intimation to the investigation officer/Officer-in-Charge of Damcherra Police Station and he shall appear before the Officer-in-Charge or the Investigation Officer once in a week for the next 2(two) months. There is no allegation that the accused petitioner did not appear on the appointed date as reflected in the order dated 14.10.2016. The bail bond, if submitted, in terms of the order dated 14.10.2016 shall remain in force.

Accordingly, this bail application stands allowed and disposed of.
