Vide judgment dated 16-09-2014, the conviction of the petitioner was upheld but keeping in view his young age and the fact that only simple injuries were caused, this Court had felt that the petitioner should be released on probation. The report of the Probation Officer was called for which has been submitted. The recommendation of the Probation Officer is that the petitioner may be released on probation on entering into a bond with surety for maintaining good conduct, behaviour and peace and may be placed under the supervision of a Probation Officer. Keeping in view the report of the Probation Officer, it is directed that the petitioner be released on probation on his entering a bond in the sum of Rs.10,000/with one surety in the like amount to maintain and keep peace and good behaviour for a period of 3(three) years from today. In addition thereto, it is directed that during this period of three years, the petitioner Tapas Das shall remain under the supervision of the Probation Officer who shall ensure that the petitioner is counseled properly and maintains peace and good behaviour during this period. In case, the petitioner violates the condition of the bond, then the order for release on probation may be cancelled and he may be directed to undergo the sentence which may be imposed in the main case. The revision petition is disposed of.
