Colony, Karmitnghat Village, Saroornagar Revenue Mandal, Ranga Reddy District, is illegal, arbitrary, unconstitutional and violation of Articles 14, 15,21 and 300-A of Constitutiorr of lndia and also violation of Principles of Natural Justice and consequently rJirect the Respondent No.4 to entertain the registration and process on the purchased Flat of the Petitioner through vide Flat No.202, Second Floor, Srirama Towers in House bearing No.B-12-96151435 and 451lsrtl202, in Survey No.60, under Ward No.8, Block No.3, which is situated at Sri Ramana:Colony, Karmanghat Village, Saroornagar Revenue [Mandal, Ranga Reddy District @ lvlarket Value.

With the consent of both the parties, this Writ Petition^is taken up for disposal at the admission stage^itself.

Heard Sri Rapolu Bhaskar, learned counsel for^the petitioner and learned Assistant Government^Pleaderfor Stamps and Registration appearing for the respondents.

Aggrieved by the action of respondent No.4 in refusing to receive, register and release the document^{presented by the} petitioner in respect of subject property i.e., Flat^No.202, Second Floor, Srirama Towers in House bearing^{No.B- 12-}

Sect-ion 7l of the Registration Act, 1908 reads as follows

Rear;ons for refusal to register to be recorded.-

(1) llvery Sub-Registrar refusing to register a document, t:xcept on the ground that the property to which it relates is not situated within his sub-district shall make an order of refusal and recorded his reasons for such order in his Book No.2, and endorse the words "registration refused" on the document; and, on application made by €Lny person executing or claiming under the document,

shall, without^{paymentand unnecessary delay,give him} a copy of the reasons^{so recorded.}

(21 No registering officer shall^{accept for registrationa} document so endorsed^{unless and until, under the} provisions hereinafter contained,^{the documentis} dirlcted to^{be registered'}

In view of the^{above submissionscoupled with the} provision und.er Section 7l^{of the RegistrationAct, 1908, this} Writ Petition is disposed^{of directingthe Registering Authority} to receive and^{process the document sought to be presented} "by the petitioner in respect of the subject^{property, subject to} the petitioner complying^{with theprovisions ofthe} Registration Act,^{1908 as well as the Indian Stamp Act, 1899'} It will be open to the^{RegisteringAuthority to refuse the} document^{presentedbeforehim, if he has any objection, duly} assigning reasons in^{support ofsuch decision and} communicate the said^{decision to the petitioner. It is made} clear that this Court^{has not expressedany opinion on merits} of the case as to^{the entitlement of the petitionerto get the} subject document^registered.
