This Writ Petition is filed seeking the following relief:-

2- Heard Sri M.v.Hanumantha Rao, learned counsel for the petitioners and sri M.Srinivas, learned Assistant Government Pleac.er for Home appearing for the official respondents and with their consent, this u,rit petition is being taken up for disposal at the admission staoe

Learned counsel for the petitioners would submit that the petitioners are the husband and wife and they have been in possr-'ssion and enjoyment of the house bearing No.1- l-2L /4g/ I situated at Ram Naresh Nagar, Hydernagar, K.p.H.B., Hyderabad. Respondent Nos.4 and s are the sisters of petitioner No.1 and they have claimed that their mother executed a Gift Deed in their favour in respect of the above house property. They tried to evict the petitioners and fited false comJrlaints against the petitioners, which were registered as crime Nos.3ol of 2024 and 862 of 2023. Crt.P.Nos.8O81 and L4965 of 2025^{before this Court and this} Court granted interim order dispensing^{with their personal} appearance before the trial Court.^{Learnedcounselfor the} petitioners would further submit that, the^{petitioners had filed a} suit for partition uide O.S.No.l2 of 2024 on^{the file of the Senior} Civil Judge, Kukatpally and respondent^{Nos.4 and 5 had also} filed a suit for perpetual injunction uide^{O.S.No.S14 ot2024 on} the file of the II Additional Junior Civil^{Judge, Kukatpally.} During pendency of the aforesaid suits,^{without conducting any} enquiry, a case in Crime No.642 of 2025^{was registered against} the petitioners on 19.05.2025,^{whichclearly demonstrates that} the petitioners are being subjected to^{harassment by filing} multiple F.l.R.s against them at the^behest of^{the unofflicial} respondents, who are none other than^{the sisters of petitioner} No.1. The grievance of the^{petitioners is that, at the instance of} the unofficial respondents, respondent-police^{have beencalling} them to the police station and^{pressurizingthem to settle the} issue with the unofficial respondents^{and interfering with the} civil disputes pending between^{the petitioners and the unof{icial} respondents

Learned Assistant Government Pleader for Home would subrr.it that insofar as Crime Nos.3OL of 2024 and 862 of 2023 are concerned, charge sheets were laid, cognizance u,as taken and lrhey were numbered as C.C.Nos.815 of 2024 and 2983 of 2024.lnsofar as Crime No.642 of 2025, which was registered on the ccmplaint lodged by respondent No.S, enquiry is in progress and notices under Section 35 (3) of the Bharatiya Nyaya Sanhita, 2023 are to be issued by strictly following the guidelines issued by tlre Hon'ble Apex Court in Arnesh Kumar Vs. Stqte of Bihart and the present '*rrit petition is filed misconceptionally and prayed to dismiss the writ petition.

Heard the learned counsel for the petitioners and learned Assis'tant Government Pleader for Home. Upon careful exarrrination of the material on record, this court deems to apprcpriate to dispose of this writ petition directing the respondent-poiice to issue notice under Section 35 (3) of B.N.S. and to follow the guidelines issued by the Hon'ble Supreme Court in Arnesh Kumar's ccse (supra). On receipt of such notic:e by the petitioners, they shall cooperate with the inver;tigating agency by liling explanation duly enclosing the

documents in support of their defence. After investigation, the respondent-police shall Iile appropriate report before the Court concerned. Further, it is made clear that, under the guise of investigation in Crime No.642 of 2025, the respondent-police shall not take any illegal action against the petitioners except following due procedure under law.

With the above directions, this Writ Petition is disposed
