This writ petition is filed challenging inaction on the part of the respondent authorities in granting permission to the petitioner for organizing bike rally on 12.09.2026 from l0 a.m. to 1 p.m. from Balapur Shivaji Chowk to Charminar Bhagyalakshmi Temple with 150 bikes holding National Flags on the occasion of Telangana Liberation Day on 17.09.2026 as illegal and arbitrary and consequently, to direct the respondents to permit the petitioner to organize the said bike rally and to

The permission may not be granted in view of ensuing Ganesh Festival.

The proposed "BIKE RALLY" route passes through narrow roads with heavy trafic, which may result in trafic congestion and disruption to emergency medical services, pedestrian and vehicular movement.

In view of the prevailing Law & Order and security situation, permission to conduct the "BIKE RALLY" on the proposed route cannot be granted. The event is also likely to cause significant congestion among the public and tourists in the suruounding areas.

3 . It is submitted that the reasons given above by the respondents cannot be sustained, as the circumstances mentioned therein did not exist as on that day. He further submiffed the petitioner wanted to hold a bike rally with National Flags and therefore it cannot have any communal touch to it. He relied upon the decision of the Madras High Court in the case of Ramasamy Udayar Vs. The District Collector, Perambalur District in W.A.No.743 of 2019, which has been followed by the Co-ordinate Bench of this Court in W.P.No.27749 of 2024, dated 03.10.2024. It is submitted that it is the responsibility of the Govemment to make appropriate arrangements to provide law and order and

Havi':rg regard to the rival^{contentions and the material on} record, this Court finds^{that the petitioner in his representationhas given} the number of bikes^{that are goingto participate in the rally with National} Flags and also thc route on^{whichthe bike rally to be held andthe time is} given as 10 a.m. to 1 p.m. Therefore,^{this Court is of the opinion that the} rally permission^()annot be^{rejectedfor the reasons that there may be or} there is a possibilitl' of^{some communities being aggrievedby sucha} rally. As long as the rally is not for^{any illegalpurposes,it is the duty of} the Govemment to maintain law^{and order and make all necessary} arrangements lo- the smooth^holding of^{such rallies.
