Telangana High Court (Division Bench: Chief Justice Aparesh Kumar Singh and G.M. Mohiuddin, J.), Writ Appeal No. 151 of 2026, decided 01.04.2026 - Telangana State Level Police Recruitment Board v. Polampelli Raju - Recruitment to 118 posts of Assistant Public Prosecutor (Category-6), Telangana State Prosecution Service, under Notification dated 15.08.2025 - Clause (vi) of Note to Para 12(A) required candidates to secure 40% and above in each of Paper-I and Paper-II to be considered for OC/EWS posts, while Clause (iv) prescribed per-paper qualifying marks of 40% (OC/EWS), 35% (BC) and 30% (SC/ST/Orthopedically Handicapped) - Held, dismissing the Board's appeal: (a) amended Rule 11 of the Telangana State Prosecution Service Rules, 1992 (substituted by G.O.Ms.No.16 dated 21.03.2023) nowhere prescribes a 40% qualifying mark in Paper-I and Paper-II for OC/EWS; its Note Clause (5) only provides that Paper-II is evaluated only for candidates who qualify in Paper-I; (b) the 40% requirement in Clause (vi), read with Clause (iv) and Para 12(B) (final selection strictly on relative merit based on aggregate score of 400 marks), is beyond the 1992 Rules and creates an impermissible and unreasonable classification not in consonance with Articles 14 and 16 of the Constitution; (c) there being no embargo in the recruitment Rules against migration of reserved category candidates to general category seats, per the principle in Union of India v. Sajib Roy (quoted in para 18 of Railway Protection Force v. Prem Chand Kumar), such migration is permissible; (d) Union of India v. G. Kiran distinguished - no preliminary qualifying examination and no concession/relaxation (fee waiver or age relaxation) was availed; (e) the principles at para 19 of Chaya v. State of Maharashtra applied - the writ Court's order setting aside Clause (vi) and permitting reserved category candidates to compete for OC posts on merit suffers no error or illegality - Writ appeal dismissed with no order as to costs; miscellaneous applications closed.
