This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioners-accused Nos.1 to 6 on bail in connection with Crime No.407 of 2026 of Khammam Rural Police Station, Khammam District, registered for the offence punishable under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel for the petitioners submits that as per the case of the prosecution, the cow is missing after it was let out for grazing, but nowhere it is mentioned that the accused have took away the said alleged cow. There is unexplained delay in lodging the report about the missing cow. Police has conducted a vehicle check, they have observed the accused wandering in a suspicious manner, but they have not found any missing cattle in their possession. Petitioners-accused Nos.1 to 6 are in judicial custody since 24.06.2026 and entire investigation is completed and prayed to enlarge the petitionersaccused Nos.1 to 6 on bail.

Learned Additional Public Prosecutor submits that the role played by the petitioners-accused Nos.1 to 6 is clearly depicted in the remand case diary.

M.Eedaiah, has lodged a report before P.S., Khammam Rural, on 24.06.2026, stating that on 20.05.2026 he took his five buffaloes and two calves for grazing and brought them back and tied them in his house around 6 PM. In the same night, he fed them. On 21.05.2026, when he woke up at 5 AM, he saw that his five buffaloes and one male buffalo are missing. Basing

on the said complaint, FIR came to be registered against unknown accused.

There is a delay of three days in lodging the complaint by the complainant.

Petitioners-accused Nos.1 to 6 were remanded to judicial custody on 25.06.2026. Remand case diary goes to show that the Police while conducting a vehicle check on 24.06.2026 they observed six people moving in suspicious manner, apprehended them and recovered cash. There is no record to show that any cattle is recovered from the possession of petitioners-accused Nos.1 to 6.

Petitioners-accused nos.1 to 6 have filed Crl.M.P.No.165 of 2026 in Crime No.407 of 2026 before the learned Magistrate for grant of bail, the same came to be dismissed.

Remand case diary goes to show that major portion of the investigation is completed and detaining the petitionersaccused Nos.1 to 6 further in judicial custody will not serve the purpose. Hence, petitioners-accused Nos.1 to 6 are entitled to be enlarged on bail, subject to the following conditions:

i. The petitioners-accused Nos.1 to 6 shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)

each, with two sureties for a like sum each to the satisfaction of the II Additional Judicial Magistrate of First Class, Khammam.

ii. The petitioners-accused Nos.1 to 6 shall appear before the concerned SHO between 10 a.m. to 5 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioners-accused Nos.1 to 6 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

iv. The petitioners-accused Nos.1 to 6 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. It is made clear that if any of the conditions imposed by this Court are violated, the prosecution is at liberty to file an application for cancellation of the bail.

10. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
