praying this Court to enlarge the petitioners–A1 to A6 on bail in connection with Crime No.405 of 2026 of PS Khammam

Rural, Khammam Commissionerate. The offence alleged against the petitioners – A1 to A6 is punishable under Section 303 (2) of the Bharatiya Nyaya Sanhita (BNS), 2023.

Heard Ms. K.Siri Vennela, learned counsel for petitioners – A1 to A6 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioners submits that as per the case of the prosecution, the cow is missing after it was let out for grazing. But, nowhere it is mentioned that the accused took away the said cows, and there is unexplained delay in lodging the report before the police. Police officials conducted a vehicle check, they observed the accused wandering in a suspicious manner, but they have not found any missing cattle in their possession. Petitioners-A1 to A6 are in judicial custody since 25.06.2026, major portion of the investigation is completed and prayed to enlarge the petitioners-A1 to A6 on bail.

Learned Additional Pubic Prosecutor submits that the role played by the Petitioners-A1 to A6 is depicted in the remand case diary and prayed to dismiss the petition.

N. Madhu has lodged a report before P.S. Khammam Rural on 23.06.2026 stating that he obtained a loan of Rs.2 lakhs from Dwakra group and purchased two buffalos, he tied them in the cattle shed, on the next day morning when he saw the buffalos were missing. Basing on the said complaint, FIR came to be registered against unknown persons.

Petitioners-A1 to A6 were arrested and remanded to

judicial custody on 25.06.2026, since then they are in jail.

¶25

Petitioners-A1 to A6 were apprehended on 24.06.2026 while they were moving in a suspicious manner and the police have recovered only cash from their possession. No cattle is recovered from the possession of the Petitioners-A1 to A6 at the time of vehicle check on 24.06.2026.

Petitioners-A1 to A6 have filed Crl.M.P.No.166 of 26 in Crime No.405, before the learned trial Court, which came to be dismissed.

Remand case diary goes to show that major portion of the investigation is completed, detaining the petitioners-A1 to A6 further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioners – A1 to A6 are entitled for grant of bail, subject to the following conditions:

i. The petitioners – A1 to A6 shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties for a like sum each to the satisfaction of learned

II Additional Judicial Magistrate of First Class, Khammam.

ii. The petitioners – A1 to A6 shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.

iii. The petitioners – A1 to A6 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner1 – A1 to A6 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
