This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner on bail who is arrayed as accused in connection with FIR No.197 of 2026 of Allapur Police Station, Cyberabad Commissionerate, registered for the offence punishable under Sections 8(c), read with 20(b)(ii)(C), 27(b), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard Sri T.Prasad, learned counsel for the petitioneraccused No.8 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

Learned counsel for the petitioner submits that petitioneraccused No.8 is innocent of the alleged offences and he is falsely implicated in the case. The entire investigation is completed, accused Nos.7, 9 and 10 were enlarged on bail by this Court on 31.08.2026 and prayed to enlarge the petitioneraccused No.8 on bail.

Learned Additional Public Prosecutor submits that role played by the petitioner-accused No.8 is clearly depicted in the remand case diary.

Petitioner-accused No.8 was arrested on 26.04.2026 and he is in remand since then.

Petitioner-accused No.8 has filed Crl.P.No.12319 of 2026 for grant of bail, which came to be dismissed vide order dated 07.08.2026, observing that long incarceration is not the criteria to enlarge the petitioner-accused No.8 on bail.

Accused Nos.7, 9 and 10 were enlarged on bail by this Court on 31.08.2026 vide Criminal Petition Nos.12863, 13149 and 13153 of 2026.

As the investigation is at the fag end, detaining the petitioner-accused No.8 further in judicial custody will not serve the purpose. Hence, petitioner-accused No.8 is entitled to be enlarged on bail, subject to the following conditions:

i. The petitioner-accused No.8 shall execute a personal bond for a sum of Rs.25,000/(Rupees twenty five thousand only) each, with two sureties for a like sum each to the satisfaction of the I Additional District and Sessions Judge-cum-Additional Family Court, Medchal, Malkajgiri District at Kushaiguda.

ii. The petitioner- accused No.8 shall appear before the concerned SHO between 10 a.m. to 5 p.m., on every Sunday for a period of Eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner- accused No.8 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

iv. The petitioner- accused No.8 shall not directly or indirectly influence,

threaten, or induce any of the prosecution witnesses.

v. It is made clear that if any of the above conditions are violated, the prosecution is at liberty to file an application for cancellation of the bail.

Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
