This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner on bail who is arrayed as accused in connection with FIR No.864 of 2026 of Uppal Police Station, Medchal Malkajgiri District, registered initially for the offence punishable under Section 194 of BNSS and later altered to Section 108 of BNS.

Heard Sri K.Venumadhav, learned counsel for the petitioner-accused and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

Learned counsel for the petitioner submits that petitioner-accused is innocent of the alleged offence and he is falsely implicated in the case. Earlier bail application filed by the petitioner-accused came to be dismissed vide order dated 18.08.2026. The changed circumstances is that investigation is completed, detaining the petitioner-accused further in judicial custody will not serve the purpose.

Learned Additional Public Prosecutor submits that the

charge sheet is filed before the concerned Court on 17.08.2026 and number is awaited.

Petitioner is shown as sole accused in the crime, he is arrested and remanded to judicial custody on 24.07.2026 and since then he is in jail.

Petitioner-accused have filed Crl.P.No.12806 of 2026 seeking bail, this Court vide order dated 18.08.2026 has dismissed the bail application. The changed circumstances is that charge sheet has been filed and number is awaited. Hence, the question of the petitioner influencing the witnesses

does not arise. Hence, petitioner-accused is entitled to be

enlarged on bail, subject to the following conditions:

i. The petitioner-accused shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of the learned VI Additional Metropolitan Magistrate, Mechal Malkajgiri District, Uppal at Malkajgiri.

ii. The petitioner-accused shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

iii. It is made clear that if any of the above condition is violated, the prosecution is at liberty to file an application for cancellation of the bail.

Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand

closed.
