This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner – A1 on bail in connection with Crime No.222 of 2026 of Gandhinagar Police Station, Gandhi Nagar Division, Hyderabad. The offence alleged against the petitioner – A1 is punishable under Sections 8 (c) read with 20 (b (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, NDPS Act’).

Heard Sri P.Vikasraj, learned counsel for petitioner – A1 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioner submits that the prosecution case in brief is that on 03.07.2026 at about 10:30 hours , police allegedly apprehended the petitioner – A1 near Alfatha Hotel, New Bhoiguda, Secunderabad while she was carrying a suitcase containing two packets of alleged ganja weighting about 2,020 grams and 2,050 grams respectively, totaling 4,070 grams. Petitioner – A1 is woman aged about 32 years and she is working as a maid servant, she denied the allegations alleged in the remand case diary, she is in judicial custody since 03.07.2026, entire investigation is completed and prayed to enlarge the petitioner – A1 on bail.

Learned Additional Public Prosecutor submits that the property which is seized is 4070 grams falls under intermediate quantity.

petitioner – A1 on 03.07.2026, basing on the said report, FIR came to be registered.

Petitioner – A1 is arrested and remanded to judicial custody on 03.07.2026, since then she is in jail. It is stated in the remand case diary that A2 – Manju @ Diddi and A3 – Rahul are still absconding.

Petitioner – A1 has filed bail petition in Crl.M.P.No.3454 of 2026 in Crime No.222 of 2026 of PS Gandhi Nagar, Hyderabad, before the learned Sessions Court, which came to be dismissed vide order dated 06.08.2026 holding that there is possibility of petitioner – A1 absconding.

As per remand case diary, the property recovered is 4070 grams worth Rs.1,00,000/-.

Respondent has examined altogether 9 witnesses. It appears from the record that most of the investigation is completed, detaining the petitioner – A1 further in judicial custody investigation will not serve the purpose. Accordingly, this Court is of the view that the petitioner – A1 is entitled for grant of bail, subject to the following conditions:

i. The petitioner – A1 shall execute a personal bond for a sum of Rs.15,000/(Rupees Fifteen Thousand only), with two local sureties for a like sum each to the satisfaction of learned X Additional Chief Judicial Magistrate at Secunderabad.

ii. The petitioner –A1 shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Wednesday and Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.

iii. The petitioner – A.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner - A.1 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Accordingly, this Criminal Petition is allowed.
