This Criminal Petition is filed under Sections 480 and

483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner – A3 on bail in S.C. NDPS No.107 of 2026 on the file of learned II Additional Sessions Judge, Nampally, Hyderabad. The offence alleged against the petitioner – A3 is punishable under Sections 8 (c) read with 20 (b (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, NDPS Act’).

Heard Sri Syed Osman, learned counsel for petitioner – A3 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioner submits that

petitioner – A3 is innocent, law abiding and honest citizen. He has no criminal antecedents whatsoever against him and

he is nothing to do with the alleged offence, he is falsely implicated in the case. Petitioner – A3 is permanent resident of Delhi, he has good reputation in the society. A2 is enlarged on bail by this Court vide order dated 25.08.2026 in Crl.P.No.11279 of 2026. Petitioner – A3 is in judicial custody since 18.12.2025 and prayed to enlarge the petitioner – A3 on bail.

Learned Additional Public Prosecutor submits that A1 is still absconding, charge sheet is filed against A2 and A3, which is numbered as S.C.No.107 of 2026 and the contraband seized is 44.854 Kgs of dry Ganja.

Petitioner – A3 has filed Crl.M.P.No.1041 of 2026 before

the learned Sessions Court in S.C. NDPS No.107 of 2026 for grant of bail, the same came to be dismissed vide order dated 29.07.2026 holding that the quantity seized is 44.854 Kgs of Ganja.

A2 – Mintu is enlarged on bail vide order dated 25.08.2026 in Crl.P.No.11279 of 2026.

Respondent has filed charge sheet against A2 and A3 which is numbered as S.C. NDPS No.107 of 2026.

This Court is conscious of the fact that petitioner – A3 is permanent resident of Delhi, if stringent conditions are imposed while enlarging on bail will meet the ends of justice. Accordingly, this Court is of the view that the petitioner – A3 is entitled for grant of bail, subject to the following conditions:

i. The petitioner – A3 shall execute a personal bond for a sum of Rs.25,000/(Rupees Twenty Five Thousand only), with two local sureties for a like sum each to the satisfaction of learned II Additional Sessions Judge, Nampally, Hyderabad.

ii. The petitioner - A3 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

iii. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

iv. The petitioner – Accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
