This Criminal Petition is filed under Sections 480 and 483

of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner – A3 on bail in connection with Crime No.197 of 2026 of PS Allapur, Cyberabad Commissionerate. The offence alleged against the petitioner is punishable under Section 8 (c) read with 20 (b) (ii) (a), 27 (b), 20 of the NDPS Act, 1985.

Heard Smt. Indira, learned counsel for petitioner –A3 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioner submits that petitioner-

A3 is falsely implicated in the case and he is law abiding citizen, having fixed abode and is ready to furnish security and sureties as ordered by the Court. Other accused are enlarged on bail. Entire investigation is completed and prayed to enlarge petitioner – A3 on bail.

Learned Additional Public Prosecutor submits that the role played by petitioner – A3 is clearly depicted in the Remand Case Diary.

Sri Mohammed Majid Ali, Sub-Inspector of Police lodged a complaint before Allapur PS, basing on which, F.I.R came to be registered.

Petitioner - A3 is arrested on 26.04.2026 and he is

produced before the concerned Magistrate, since then he is in judicial custody. Remand case diary goes to show that 14

witnesses have been examined by the prosecution. It is to be noted here that accused Nos.7, 9 & 10 are enlarged on bail by this Court vide Crl.P.Nos.12863, 13149 and 13153 of 2026, dated 31.08.2026.

Since major portion of the investigation is completed, detaining petitioner-A3 further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioner – A3 is entitled for grant of bail, subject to the following conditions:

i. The petitioner – A3 shall execute a personal bond for a sum of Rs.25,000/(Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of learned I Additional District & Sessions Judge, Medchal – Malkajgiri, Malkajgiri District.

ii. The petitioner – A3 shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.

iii. The petitioner – A3 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner - A3 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Accordingly, this Criminal Petition is allowed.
