This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner – Accused on bail in connection with Crime No.393 of 2026 of Kollur Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are punishable under Sections 64 (2)(m) of the Bharatiya Nyaya Sanhita, 2023 (BNS), Section 5 (1) read with 6 of the POCSO Act, 2012 and Sections 9 and 10 of the Prohibition of Child Marriage Act.

Heard Sri Bommagani Prabhakar, learned counsel for petitioner – accused and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioner submits that the petitioner-accused is innocent of the offences alleged against him and he has been falsely implicated in the case. Petitioner – accused has been in judicial custody since 29.07.2026. Entire investigation is completed and charge sheet also came to be filed, further investigation by the prosecution does not arise and prayed to enlarge the petitioner – accused on bail.

Learned Additional Public Prosecutor submits that statement of the victim under Section 183 of the BNSS is recorded and charge sheet came to be filed on 17.08.2026 before the concerned Court.

Notice got issued to mother of the victim, is served, proof is filed to that effect.

T he de facto complainant lodged a report before PS Kollur on 22.07.2026, stating that her daughter’s Class teacher informed her that the victim had not attended the

college on 12.07.2026. On making enquiry at Peddapally Village, the complainant was informed that her daughter had been seen at the house of Perumalla Mahesh in the said village, she came to know that Mahesh was in the house. During the said period her daughter came in contact with Mahesh and they had a physical relationship. Basing on the said complaint, FIR came to be registered.

7. Learned counsel for the petitioner submits that the petitioner–accused voluntarily surrendered before the police on 29.07.2026 and was arrested and remanded to judicial custody on the same day, since then, he is in jail.

8. Remand case diary goes to show that respondent has examined 14 witnesses.

9. Statement of the victim under Section 183 of the BNSS

is already recorded and charge sheet is filed before the concerned Court, the question of influencing the witnesses by the petitioner – accused does not arise.

10. It is to be noted here that the age of the victim is 16 years as on the date of alleged offence. Record shows that she is five months pregnant.

petitioner – accused further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioner – accused is entitled for grant of bail, subject to the following conditions:

i. The petitioner – accused shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of learned Special Judicial First Class Magistrate, Prohibition and Excise Offences Court, Sangareddy.
