This Criminal Petition is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioners – A1 and A2 on bail in connection with Crime No.163 of 2026 of Kanchanbagh Police Station, Chandrayangutta. The offences alleged against the petitioners are punishable under Section 75 of the Bharatiya Nyaya Sanhita, 2023 (BNS), Section 5 (f)(m) read with 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 75 of the Juvenile Justice (Care and Protection of Children) Act 2015.

Heard Sri P.Rana Kamalasan, learned counsel for petitioners –A1 and A2 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioners submits that the petitioners – A1 and A2 are falsely implicated in the case, they are nothing to do with the alleged offence. Petitioners – A1 and A2 are Teachers in Madarsa. Earlier bail application filed by the petitioners – A1 and A2 came to be dismissed on 11.08.2026. The changed circumstances is that charge sheet is filed before concerned Court and number has to be assigned, prayed to enlarge the petitioners – A1 and A2 on bail.

Notice is given to mother of the victim, same is served and proof is filed to that effect.

Petitioners – A1 and A2 are remanded to judicial custody on 18.06.2026, since then they are in jail.

Petitioners – A1 and A2 have filed Crl.P.No.12006 of

2026 for grant of bail, the same came to be dismissed vide order dated 11.08.2026 with an observation that specific overt acts are attributed against the petitioners – A1 and A2.

The Changed circumstances is that police has filed charge sheet on 03.09.2026, which is taken on file by the learned trial Court.

8. Since charge sheet came to be filed, d etaining the petitioners – A1 and A2 further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioners –A1 and A2 are entitled for grant of bail, subject to the following conditions:

i. The petitioners – A1 and A2 shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of learned XII Additional Sessions Judge-cumPOCSO Court at Nampally, Hyderabad.

ii. The petitioners – A1 and A2 shall not involve in similar offences.

iii. The petitioners – A1 and A2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioners - A1 and A2 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
