This Criminal Petition is filed under Sections 480 and

483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner –A2 on bail in connection with Crime No.317 of 2025 of PS Masab Tank Banjara Hills, Hyderabad. The offence alleged against the petitioner is punishable under Section 8 (c), 22 (c), 27 (a) of the Narcotic Drugs and Psychotropic Substances Act, 1985, read with Section 3 (5) of the Bharatiya Nyaya Sanhita (BNS), 2023.

Heard Sri Khaja Arajuddin, learned counsel for petitioner – A2 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioner submits that the petitioner – A2 is falsely implicated in the case and he is nothing to do with the alleged offence. The earlier bail application filed by the petitioner – A2 in Crl.P.No.11653 of 2026, came to be dismissed vide order, dated 12.08.2026 with an observation that the petitioner – A2 is involved in Crime No.105 of 2025, in which case he is enlarged on bail by the learned Sessions Judge in Crl.M.P.No.1535 of 2025. A1 is enlarged on bail by this Court on 12.08.2026 vide Crl.P.No.11660 of 2026. A3 is enlarged on bail by this Court on 09.06.2026 vide Crl.P.No.8046 of 2026. The petitioner – A2 is in judicial custody since 13.12.2025 and prayed to enlarge the petitioner – A2 on bail.

Learned Additional Public Prosecutor submits that the role played by the petitioner – A2 is depicted in the remand case diary and prayed to dismiss the petition.

Petitioner – A2 is arrested and remanded to judicial custody on 13.12.2025, since then he is in jail.

A1 has filed Crl.P.No.11660 of 2026, wherein he was enlarged on bail by this Court on 12.08.2026. A3 has filed Crl.P.No.8046 of 2026 and he is enlarged on bail by this Court on 09.06.2026.

The earlier bail application filed by the petitioner – A2 in Crl.P.No.11653 of 2026, came to be dismissed on 12.08.2026 with an observation that petitioner – A2 is involved in Crime No.105 of 2025.

Petitioner – A2 has placed bail order, dated 04.04.2025 in Crl.M.P.No.1535 of 2025 in Crime No.105 of 2025 of PS Amberpet, Hyderabad, in which he is enlarged on bail

9. A1 and A3 were already enlarged on bail. Hence, detaining the petitioner – A2 further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioner – A2 is entitled for grant of bail, subject to the following conditions:

i. The petitioner – A2 shall execute a personal bond for a sum of Rs.10,000/(Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of learned VI Additional Chief Judicial Magistrate, Nampally, Hyderabad.

ii. The petitioner –A2 shall appear before the concernerd SHO between 10:00 AM and 5:00 PM on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, a an when required.
