This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner – A1 on bail in connection with Crime No.828 of 2026 of Uppal Police Station, Malkajgiri Division, Malkajgiri District. The offences alleged against the petitioner are punishable under Sections 69 and 351 (2) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2. Heard Sri B.Koteswara Rao, learned counsel for petitioner –A1 and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

Learned counsel for the petitioner submits that petitioner –A1 has no criminal antecedents and he is a law abiding citizen, working as a private teacher by profession, he hails from a respectable family. Section 69 of the BNS is punishable with imprisonment which may extend to ten years. Petitioner-A1 has not committed any offence and he is in judicial custody since 17.07.2026, entire investigation is completed and prayed to enlarge petitioner – A1 on bail.

Learned Additional Public Prosecutor submits that the role played by petitioner – A1 clearly depicted in the Remand case diary. Statement of the victim under Section 183 of the BNSS is recorded on 14.08.2026.

De facto complainant has lodged a report before PS Uppal on 18.06.2026 stating that petitioner-A1 came in contact with her through a matrimonial platform for the purpose of marriage. During their regular interactions, he repeatedly assured her that he intended to marry her. The victim developed close relationship with her and entered into physical relationship on multiple occasions between 08.02.2026 and 14.02.2026 at OYO Hotel, near Uppal Cross

Roads. Basing on the said complaint, F.I.R came to be registered.

Petitioner – A1 is arrested on 17.07.2026 and produced before the concerned Magistrate, since then he is in judicial custody.

Remand case diary shows that prosecution has examined 13 witnesses.

Statement of victim under Section 183 of BNSS is recorded on 14.08.2026.

Since major portion of the investigation is completed, detaining the petitioner - A1 further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioner – A1 is entitled for grant of bail, subject to the following conditions:

i. The petitioner – A1 shall execute a personal bond for a sum of Rs.10,000/(Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of learned VI Additional Metropolitan Magistrate at MedchalMalkajgiri District, Uppal at L.B.Nagar.

ii. The petitioner –A1 shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Sunday for a period of four (4) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.

iii. The petitioner – A.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner - A.1 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
