This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) praying this Court to enlarge the petitioner – Accused on bail in connection with Crime No.355 of 2026 of Pocharam IT Corridor Police Station, Malkajgiri District. The offences alleged against the petitioner are punishable under Sections 64 (1) and 303 (2) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

Learned counsel for the petitioner submits that petitioner – accused is taken for two (2) days police custody and the statement of victim under Section 183 of the BNSS is recorded. The changed circumstances after dismissal earlier bail petition, dated 11.08.2026 is that entire investigation is completed and prayed to enlarge the petitioner-accused on bail.

Learned Additional Public Prosecutor submits that the

statement of the victim under Section 183 of the BNSS is recorded and that the petitioner-accused is taken for two (2) days police custody.

De facto complainant has lodged a report before Pocharam IT Corridor police station on 08.07.2026, wherein, she stated that “accused has forcibly committed sexual intercourse with her and committed theft of her mobile phone and some net cash and fled away from thereby leaving her.” Basing on the said report, F.I.R came to be registered.

Petitioner-accused has filed Crl.P.No.12611 of 2026 for

grant of bail, the same came to be dismissed on 11.08.2026.

It is observed in the order that though respondent has examined LWs.1 to 14, apart from examining two police officers, Section 183 of BNSS statement of victim girl is not recorded as on date (11.08.2026) thereby the bail application came to be dismissed.

The changed circumstances is that petitioner-accused is taken for two (2) days police custody and furthermore the statement of victim under Section 183 of the BNSS is already recorded.

Since investigation is at fag end, detaining the petitioner-accused further in judicial custody will not serve the purpose for the prosecution. Accordingly, this Court is of the view that the petitioner – accused is entitled for grant of bail, subject to the following conditions:

i. The petitioner – accused shall execute a personal bond for a sum of Rs.10,000/(Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of learned II Additional Sessions Judge at V Additional Metropolitan-cum-Additional Judicial Magistrate of First Class at Medipally, Medchal-Malkajgiri District.

ii. The petitioner – accused shall appear before the concerned SHO between 11:00 a.m. and 5:00 p.m., on every Sunday for a period of four (4) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.

iii. The petitioner – accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv. The petitioner - accused shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. In the event of violation of any of the above conditions, the prosecution is at liberty to file an application for cancellation of bail.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
