This Criminal Petition is filed under Sections 480 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in connection with FIR No.333 of 2026 of Sathupalli Police Station, Khammam District, registered for the offences punishable under Sections 111(2)(b), 318(4) read with 3(5) of BNS, 2023.

Heard Sri K. Durga prasad, learned counsel for the petitioner-accused No.1 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

Learned counsel for the petitioner submits that Section 111(2)(b) of the BNS cannot be attracted against petitioner-accused No.1, which is misconceived and unsustainable. Similarly, Section 318(4) of the BNS is also not attracted. Petitioner-accused No.1 is the driver of the tipper and his entire family is depending on his earning. Petitioner-accused No.1 is arrested on 09.08.2026 and he is produced before the concerned Magistrate, since then he is in jail. Entire investigation is completed and prayed to enlarge the petitioner-accused No.1 on bail.

Learned Additional Public Prosecutor submits that the petitioner-accused No.1 is involved in two other crimes of P.S., Sathupalli and P.S., Vemsoor and the present crime is the third one. The role played by the petitioner-accused No.1 is depicted in the remand case diary.

LW.1-S.Veera Prasad, Sub-Inspector of Police, has lodged a report before the P.S., Sathupalli, on 08.08.20206, stating that petitioner-accused No.1, who is the tipper driver and accused No.2A.Veera Venkata Sathish, owner of the tipper, accused No.3A.Suresh, driver of tipper bearing No.AP 39 TF 0567, were the organizers and they were apprehended by the Police while they

were illegally transporting the sand from Vadapalli ramp at the East Godawari District to Sathupalli in tipper bearing No. AP 39 TF 0567. Basing on the said report, FIR came to be registered.

Petitioner-accused No.1 is arrested on 09.08.2026 and he is remanded to judicial custody on the above said date. It is mentioned in the remand case diary that accused No.2- A.Veera Venkata Sathish and accused No.3- A.Suresh were absconding.

Learned counsel for the petitioner on instructions submits that accused Nos.2 and 3 have obtained anticipatory bail from this Court on 03.09.2026, which is not disputed by the learned Additional Public Prosecutor.

Remand case diary goes to show that accused No.1 is involved in Crime No.558 of 2025 in P.S., Sathupalli and in Crime No.67 of 2026 in P.S., Vemsoor, in a similar set of offences. Petitioner counsel submits that the petitioner-accused No.1 is enlarged on bail in both the crimes.

Remand case diary further goes to show that prosecution has examined LWs.1 to 7. The owner of the tipper is already granted anticipatory bail by this Court on 03.09.2026. Major portion of the investigation is completed and detaining the petitioner-accused No.1 further in judicial custody will not serve the purpose. Hence, petitioner-accused No.1 is entitled to be enlarged on bail, subject to the following conditions:

i. The petitioner-accused No.1 shall execute a personal bond for a sum of Rs.10,000/(Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of the concerned Court.

ii. The petitioner-accused No.1 shall appear before the concerned SHO between 10 a.m. to 5 p.m., on every Sunday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner-accused No.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

iv. The petitioner-accused No.1 shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v. It is made clear that if any of the conditions imposed by this Court are violated, the prosecution is at liberty to file an application for cancellation of the bail.

Accordingly, the Criminal petition is allowed.
