This Criminal Petition is filed under Sections 480 &

483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) praying this Court to enlarge the petitioner-A3 on bail in connection with P.R.C.No.77 of 2024 in Crime No.11 of 2024 on the file of I Additional Judicial Magistrate, Ranga Reddy District, at L.B.Nagar. The offences alleged against the petitioner-A3 are under Sections 147, 148, 302 read with 149 of IPC and Section 27(1)(A) of the Arms Act, 1959.

Heard Sri Syed Osman, learned counsel for the petitioner-A3 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

Learned counsel for the petitioner submits that the petitioner failed to appear before the learned Magistrate on 20.04.2026, thereby NBW came to be issued against him. On 02.05.2026 NBW is executed by the police and he was arrested, has been remanded to the judicial custody. Since 02.05.2026 he is in jail. Charge sheet which is filed by the police is still at PRC stage. Counsel further submits that A4-Shaik Hussain who was enlarged on bail by this Court in Crl.P.No.8367 of 2026 dated 18.06.2026 whereunder he was also sent to judicial custody on execution of NBW on 02.05.2026.

Petitioner-A3 is facing the charges under Section 302 r/w 34 of IPC. Charge sheet is filed before the learned Magistrate and which is at PRC stage, on 20.04.2026 petitioner-A3 and A4-Shaik Hussain failed to appear before the concerned Magistrate thereby NBW came to be issued, subsequently police has executed NBW against the

petitioner-A3 and A4-Shaik Hussain and they were arrested and sent to judicial custody on 02.05.2026. Petitioner-A3 is in jail since 02.05.2026.

A4-Shaik Hussain is enlarged on bail by this Court in

Crl.P.No.8367 of 2026 dated 18.06.2026 on conditions.

PRC No.77 of 2024 of P.S. Balapur is still pending before the learned I Additional Judicial Magistrate, Ranga Reddy District, at L.B.Nagar. Petitioner-A3 has made out a case for grant of bail. Hence, the petitioner-A3 is entitled to be enlarged on bail, subject to the following conditions:

i. The petitioner-A3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Judicial Magistrate of Ranga Reddy District, at L.B.Nagar.

ii. The petitioner-A3 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iii. However, the petitioner-A3 is directed to appear before the trial Court on every adjournment and as and when required.

Accordingly, this Criminal petition is allowed.
