Petition under Article 226 of the Constitution of lndia^praying thatⁱⁿ the circumstances stated in the affidavit filed therewith, the High Court may^be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the inaction of the respondentsⁱⁿ taking action against the 6th respondent and his associates^who are^{indulging in} the acts of trespassing into the^petitioners land and threatening to dispossess^and grab his agricultural lands, inspite of the oral complaints followed by written complaints dt. 18-12-2024, 5-2-2025 and reminder dt. 14-2-2025, as being^illegal, arbitrary, unjust and unconstitutional and consequently direct the^respondent

This writ petition is filed by the petitioner seeking to declare the action of respondent No.5 - Station House Officer, Shamirpet Police Station, in not registering the First lnformation Report on his complaint made against respondent No.6 and his associates who are indulging in the acts of trespassing into his land and threatening to dispossess him and grab his agricultural lands, as being arbitrary and unconstitutional.

Heard Mr. S. Prasad Babu, learned counsel for the petitioner, and Mr. Mahesh Raje, learned Government Pleader for Home, and perused the material available on record

Learned Government Pleader for Home, placed on record written instructions received by him. lt is stated that the petitioner's cousin brother by name Dasari Krishna Reddy lodged a similar complaint in connection with same property and incident and FlR.No.5 of 2025 was registered with Shamirpet Police Station for the offences under Sections 126 (2), 351 (2) and 352 read with Section 3 (5) of Bharatiya Nyaya Sanhita, 2023. The petitioner will be summoned as witness and his statement will be recorded and he may be directed to furnish documentary evidence in support of his case.

As FlR.No.5 o'f 2025 was registered in connection with same cause of action, the lnvestigation Officer is directed to treat the complaint of the petitioner as evidence and record the statement of the petitioner and also give him an opportunity to submit necessary documents/information in support of his case
