Petition under Article 226 ot lhe Constitution of lndia^praying that in the circumstances stated in the affidavit filed therewith, the High Court^maybe pleased to issue a direction, order or writ more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents, more^particularly respondent No.3 in not disposing the^petitioner's letter dated 08-08-2024^as illegal, arbitrary and u nconstitutional and direct the respondents,^particularly respondent No.3 to dispose of the^petitioner's letter dated 08-08-2O24^by incorporating the changes sought therein.

Heard learned counsel for the petitioner and Learned Assistant Government Pleader for Stamps and Registration appearing for respondent Nos.1 to 3. With their consent, the writ petition is being taken up for disposal at the admission stage itself .

This writ petition has been filed seeking the following prayer:-

"to declare the inaction of the respondents, more particularly respondznt No.3 in not disposing tht petitioners letter dated 08.08.2024 ns illegal, arbitrary and unconstittrtionnl and direct the respondents pnrtidarly respondent No.3 to dispose of the petitioner's btter dated 08.08.2024 by incorporating the changes sought therein."

Brief facts of this writ petition are that petitioner is a foundation established in the year 1993, with an objective to help poor and needy children and the same was registered aidz regn.No.3639 of 1993 dated 10.09.1,993, with its office bearers, Sri.l.J.Komanapalli as president, Sri.G.V.Rathna Raju as vice president, Sri Ruth Komanpalli as general secretary, Kum.Carman Miryam as ioint secretary and Sri.J.Sudershan as treasures. The saicl president died on 27.04.2005 and thereafter a meeting was conducted on 31.05.2005, wherein a new body was elected for a period of five years i.e.,2005 to 2010 and thereafter, for every five years i.e., from 2010 to 20'l'5, 201'5 to 2020 and 2020 to ?025 a new body was elected. that during the term of 2020 to 2025, the petitioner's regd. Office was shifted from Banjara Hills, Hyderabad to Attapur, Hyderabad and in the said period the existing body decided to take up several developmental activities with regard to schools, hospitals, orphanages etc., and the same were recorded in the minutes. The petitioner society with an intention to incorporate the above said changes in the records, addressed a letter dated 08.08.2024 and requested respondent No.3 to effect the changes in the office record and issue amended copy. Grievance of the petitioner is that inspite of acknowledging the aforesaid letter on 16.72.2024, respondent No.3 has kept the same pending. Aggrieved by the same, present writ petition is filed.

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent authorities to consider the petitioner's letter dated 08.08.2024 and effect the changes in the office record in a time bound period

Learned Government Pleader appearing for respondents submits that if the petitioner's letter dated 08.08.2024 is still pending for consideration; the respondent authorities may be directed to dispose of the same and pass appropriate orders in accordance with law.

In view of the subrfiission made by^learned counsel appearing on either side and without expressing any opinion on the merits of the case, this writ petition is disposed of directing the respondent^authorities to consider the

petitioner's letter dated 08.08.2024 and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within a period of three (03) r.veeks from the date of receipt of copy of this order and communicate the same to the petitioner.
