Petition Under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue any appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of Respondent No.2 herein in issuing the passport after submission of application as per the provisions of the act vide application in file No. HYL077396456325 as illegal, arbitrary and violative of Articles. 14, 19 and 21 of the Constitution of lndia and consequently direct the Respondent No.2 to issue passport to the petitioner in file No.HYL077396456325.

ORDER:

The petitioner submitted an Online Application (No.HYl077396456325dated 12.02.2025) seeking issuance of passport. Howeveg the 2ndrespondent-passport authority has refused to issue passport on the ground that the petitioner is facing criminal proceedings in C.C.No.90 of 2025on the file of Judicial Magistrate of First Class, Wanaparthy.

Heard Mr. Kadire Ajith Reddy, learned counsel for the petitioner; and learned Standing Counsel for the Central Govemment. Perused the record. 3. At the hearing, both the leamed counsel submit that the present writ petition is covered by the Order dated 03.09.2025 passed by this Court in W.P.No.24690 of 2025.

Considering the respective submissions,this , rurt directs the 2nd respondent-passport authority to consider the Online A1 plication filed by the petitioner on the following conditions:

i) The petitioner herein shall submit an underta( rg along with an affidavit in C.C.No.90 of 2025, pending on the file of Jurt ;ial Magistrate of First Class, Wanaparthy, stating that he shall not Irr ve lndia during pendency of the said C.C., without permission of the I turt and that he shall cooperate with trial Court in concluding the proce3 lings in the said C.C.;

ii) On filing such an undertaking as well as affid I it, the trial Court shall issue a certified copy of the same within two (2) wer:t s therefrom;

iii) The petitioner herein shall submit an applic;r on afresh along with ce(ified copy of this order as well as the aforesaid rrr Certaking before the Passport Officer /Authority concerned for issuance o. assport,

iv) On filing such an application, the Passport C Fficer / Authority shall consider the same afresh in the light of the observa i, ns made by this Court herein as well as the contents of the undertatit g given by the petitioner for issuance of passport, in accordance with lw within three (03) weeks from the date of said application;

v) Respondent No.2 shall consider Rule 12 of th: >assport Rules, 1967 while considering the aforesaid application s I lmitted by the petitioner;

vi) On issuance of the Passport, the petitioner hr r rin shall deposit the same before the trial Court in C.C.No.90 of 2025, penc ng on the file of Judicial Magistrate of First Class, Wanaparthy; and

vii) However, liberty is granted to the petitioner 1 erein to file an application before the leaned Magistrate seeking perrn ssion to travel abroad, and it is for the learned Magistrate to consirj, r the same in accordance with Iaw.

Accordingly, the writ petition is disposed of. No r lsts. Miscellaneous petitions, if any pending, shall stand closed.
