Heard Mr. A.V.A. Siva Kartikeya, learned counsel/ representing Mr. A.V. Krishna Koundinya, learned counsel for 1-he appellant, and Ms. Bokaro Sapna Reddy, learned Senior Standing Counsel for income Tax Department appearing on behalf of the respondent.

The instant appeal has been filed by the appellant challenging the order passed by the Income Tax Appellate Tribunal, Hyderabad Bench 'A', Hyderabad (for short 'ITAT') in ITA. No.379lHyd/04, for the assessment year 1999-2000, which stands decided on 31.08.2007.

Vide the impugned order, the ITAT disallowed the claim of interest to the tune of Rs.71,75,072/- which according to thr: appellant was by way of certain unsecured loans that he has obtained during the period 1985-86.

Today when the matter is taken up for hearing, learned counsel for the appellant submits that pursuant to the impugned order of remand by the ITAT, the Assessing Officer has passed a consequential order on

14.03.2005 and has decided the case in favour of the appellant holding that there is genuineness of the payment of interest and identity of the creditors which coulci not be doubted.

In view of the consequential order being passed pursuant to the impugned order of remand by the ITAT, we are of the considered opinion that nothing further remains to be adjudicated in the instant appeal. Accordingly, the instant appeal stands disposed of in Iight of the consequential order passed by the Assessing Officer on 14.03.2005. No costs.
