This Civil Revision Petition is hled seeking to dispose of the I.AiNo.38 of 2023 inO.S. No.216 of 2022 on the file of the Junior Civil Judge -rum- Judicial Magistrate of First Class at Thormr.

Heard Sri D. Ramakrishna, learned counsel for the petitioner. Despite receipt of notice to respondent Nos.l and 2, there is no appea-r€rnce on their behalf, to that extent learned counsel for the petitioner filed a memo of proof of service of notice vide USR No.91312 of 2025, dated 29.08.2025.

Learned counsel for the petitioner would submit that the petitioner filed arr I.A. No.38 of 2023 in O.S.No.216 of 2022 :under Section 5 of Limitation Act read with Section 151 of C.P.C, on the {ile of the Junior Civil Judge -cumJudicial ly[a gistrate of First Class, Thorrur to condone the delay of 135 days in filing the petition for setting aside the ex-parte decree passed in O.S. No.216 of 2022 dated L4.O7.2023, and which is pending for adjudication and^he

has been deprived of expeditious trial. Hen< e, he would seek to pass appropriate order.

Having heard learned counsel for the pet tioner, non_ appearance of the respondents despite receipt r f notice and also considering the fact that the suit is of tlL, year 2022, this Court deems it appropriate to dAect the earned trial Court to dispose of the I.A.No.3g of 2024 in C) S No.2l6 of 2022 and pass appropriate orders in accordar ce with law as expeditiously as possible.
