CRIMINAL PETITION No.9884 of 2025

ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.1 in Crime No.168 of 2025 of Amangal Police Station, Shad Nagar, Cyberabad, on bail, the present criminal petition is filed.

The brief facts of the case are that on 23.06.2025 at about 22:00 hours, the complainant lodged a report before the police stating that he is the father of two sons and two daughters. He solemnized the marriage of his deceased daughter with accused No.1 and at the time of the marriage, he gave a cash dowry of Rs.10,00,000/- (Rupees Ten Lakhs only). Subsequently, the accused and his parents subjected the deceased to physical and mental harassment, demanding additional dowry. Thereafter, an additional amount of Rs.10,00,000/(Rupees Ten Lakhs only) was paid by the complainant in the presence of village elders, and the deceased was sent back to her matrimonial home. However, despite this, the accused continued to harass the deceased in the same manner. A case was registered against the petitioner/accused, and the police conducted counseling sessions and admonished accused No.1 in the presence of village elders. Despite such efforts, the petitioner did not mend his behavior and habitually returned home in a drunken state, physically assaulted the deceased, and abused her in filthy language. Unable to bear the continued harassment, the deceased ultimately committed suicide. Based on the

complaint, the police registered a case in Crime No. 168 of 2025 of Amangal Police Station, Shadnagar, Cyberabad, for the offences punishable under Sections 85, 80 read with 3(5) of the Bharatiya Nyaya Sanhita (BNS). The petitioner was arrested and remanded to judicial custody on 26.06.2025.

Heard Ms. Mogili Anaveni, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner firstly submitted that the petitioner is innocent and has been falsely implicated in the present case. Secondly , it is contended that the deceased committed suicide on account of ill health, and not due to any harassment, as alleged by the de facto complainant. It is further submitted that the petitioner has no criminal antecedents and has been in judicial custody for the past 45 days. Learned counsel also submitted that the petitioner has minor children to take care of, and the grandparents are too old to look after them in his absence. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the petitioner was arrested on 26.06.2025 and there are specific allegations against the petitioner. The previous incidents shows that there is a dowry harassment by the petitioner.

Previously also the deceased complained to the elders and to the police and after counseling the petitioner was changed his attitude. Hence, he prayed the Court to dismiss the criminal petition.

After considering submissions from both the parties and material available on record, it is apparent that there are no criminal antecedents against the petitioner; according to the prosecution, deceased had committed suicide by pouring kerosene herself and remand C.D shows that the material part of the investigation is completed and 16 witnesses were examined. Considering that the investigation done by the investigation officer and the petitioner is in jail since 26.06.2025. In the said circumstances, this Court is of the considered view that it is a fit case for grant of bail to the petitioners, subject to the following conditions:

i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate, at Amangal.

ii. The petitioner shall appear before the concerned Station House Officer on every Monday at 11:00 A.M., for a period of eight (08) weeks or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when
