The brief facts of the case are that the de-facto complainant

lodged a complaint on 04.07.2025 stating that his daughter, D. Sandya, aged about 20 years, committed suicide by consuming pesticide poison (Grass) and was shifted to SVS Hospital, Mahabubnagar. At that time, all the family members were not in the house. It is further stated that initially they thought that the deceased consumed pesticide because she had been reprimanded regarding a love affair. Thereafter, on 03.07.2025, the statements of the de-facto complainant and other witnesses were recorded, wherein, it was stated that he came to know through his son that on the date of the incident the petitioner herein left the deceased in their house. Thereafter, based on the statements of LWs 1 to 3, the Sub-Inspector of Police altered the section of law from Section 194 BNSS to Section 108 BNS.

Heard Sri C. Lalit Kumar Reddy, learned counsel for the petitioner, and Sri E. Ganesh, learned Assistant Public Prosecutor appearing for respondent – State.

The contention of the petitioner herein is that the petitioner is innocent of the allegations. The de-facto complainant, by reporting an order to the Police, and the family members admonished the deceased, as a result of which she committed

suicide and falsely implicated the petitioner herein. Their statements were altered after three months of the investigation, and based on the same, the police registered the case against the petitioner, which is nothing but a false case. As such, the petitioner prays the Court to grant Anticipatory Bail.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner were serious in nature and custodial interrogation of the petitioner is necessary for further investigation. Hence, he prayed the Court to dismiss the criminal petition.

Upon considering the rival submissions and perusing the material on record, the alleged offence against the petitioner under Section 108 of BNS shows that there is no incriminating evidence collected by the Investigating Authority, and there is a gap of three months between the final report of the Investigation and the alteration of the Section of law. Hence, this Court finds it appropriate to grant anticipatory bail to the petitioner, subject to the following conditions:

i. The petitioner shall surrender before the Station House Officer, II-Town Police Station Mahabubnagar, Telangana, within two weeks

from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii. The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii. The petitioner shall appear before the concerned Investigating Officer on every Monday for a period of (08) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.
