This Criminal Petition is filed seeking to quash the

proceedings in FIR No.287 of 2025, on the file of the Jogipet Police

Station, Sangareddy District, wherein the petitioners were anayed as

accused Nos. I and 2, for the offences punishable under Sections

¶37

318(4) and 351 r/w 3(5) of the Bharatiya Nyaya Sanhitha,2023.

Heard Mr.K.Ravinder Reddy, leamed counsel for the petitioners and Mr.Jithender Rao Veeramalla, learned Additional

Public Prosecutor for respondent No.I -State.

Learned counsel for the petitioners raised sev,l ol grounds, but restricted his prayer requesting the Court to direct J e lnvestigating Of ficer to follow the procedure as contemplated urtrl :r Section 4l-A of the Criminal Procedure Code, 1973 (for short.^'- r.P.C.')/Section 35(3) of the Bharativa Nagarik Suraksha Sanhita. .023 (for short, 'BNSS') and also the guidelines formulated by thr: Apex Court in Arnesh Kunrar Vs. State of Bihart, since the r, lences levelled against the petitioners are punishable with imprisc r ment o[ below seven years.

Learned Additional Public Prosecutor subr titted that the petitioners may be directed to appear before the Inves igating Officer, and on such appearance, the Investigating Officer lill issue notice under Section 4l-A of the Cr.P.C./Section 35(3) o'rhe BNSS. Taking into consideration the facts and circrr nstances of the case and the submissions made by the respective tarties, without expresslng any view on the merits of the case, the pct Ltioners/accused Nos. I qd 2 are directed to appear before the lnvestill ,ting Officer, on
