This Criminal Petition is frled under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.2 in Crime No.79O of 2025 before the Cyber

Crimes Police Station, Rachakkonda Commissionerate, registered for the offences punishable under Sections 3 16(2), 319(2),318(4), 338 of BNS and Sections 66-C, 66-D of IT Act, 2000-2008.

The brief facts of the case are that the complainant, a B.Tech student, was contacted on 26. lO.2024 by one Narayana, who promised a backdoor job in Wipro and collected Rs.60,0O0/- from her. Shc was then introduced to another person, Vinay Kuppili, u'ho conducled fake interviews and collected further amounts as 'Joining fee," "onboarding fee," and other charges, totalling Rs.3,6O,O00/ - through multiple UPI transactions. Fake offer letters and onboarding documents were issued, and once the money was paid, the accused persons became unreachable. Upon verification, all documents were found to be forged, and the complainant lodged a complaint.

Heard Sri Mogili Anaveni, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner u,as innocent and had been falsely implicated without any material evidence and that the police registered the crime mechanically without conducting a preliminary inquiry. and that the main role was attributed only to accused No. 1 , who had admitted to creating fake lDs, olfer letters, and Aadhaar cards. He further submitted that no custodial interrogation was required, the petitioner had no role in the alleged offences, and he himself was a victim who had paid Rs.4,OO,OOO/ - to accused No. I for securing a job. Thcrefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. Therefore, at this stage,-granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition.

available on record, it prima facie appears that the petitioner is arrayed as accused No.2 and that specific allegations are levelled against him of having acted in concert with accused No. I in luring innocent victims under the €iuise of providing backdoor employment in reputecl companies. The malerial placed before this Court indicates that, according to the statement of accused No. I , it u,.as the petitioner who induced and facilitated the commission of the alleged offences. It is also brought to the notice of this Court that there are several victims who are stated to have Lreen cheated in a similar manner and that the investigation is still at initial stage. In view of the nature and gravity of the allegations, the alleged role attributed to the petitioner, at this stage, this Court is not inclined to grant pre-arrest bail to the petitioner and the same is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed.
