This Criminal Petition is filed^{under Section528 Bharatiya} Nagarik Suraksha Sanhita, 2O23^(for short^{'BNSS') by tte} petitioners/accused Nos.1 to 3 seeking to^{quash the proceedings} against them in Crime No.434 ot^{2025 on the file of Begumpet} Police Station, Hyderabad District,^{registered for the alleged} offences punishable under Sections^{31S (} )^{and 316 (5) r/w. 3 (5)} of Bharatiya Nyaya Sanhita ,2023^{(tor short 'BNS').}

Heard Mr.J.C.Francis, learned^{counsel for the petitioner} and Mr.Jithender Rao Veeramalla,^{learned AdditionalPublic} Prosecutor appearing for the^{respondentNo.1.}

The learned Additional^{Public Prosecutor submittedthat in} Crime Nos. 2O2,2O3, and^{217 ot 2O25,the petitioner had earlier} filed quash^petitions, wherein this^{Court had directed the police to} serve notice under Section^{35(3) of the BNSS. However,the} petitioner failed to appear before the concerned^{policestation and} has not received the notioe till date. .I

That being so, the leamed counsel for the petitioner submifted that the petitioner would comply with the directions. lt is brought to his notice that the case hdS subsequenfly been transfened to the CCS. He further stated that he would inform the accused and ensure that the orders are complied with in the earlier cases as well.

Considering the submissions of both the counsel and similar orders are passed in this case also. Hence, without going into the merits of the case, this Court deems it appropriate to direct the petitioner to appear before the lnvestigating Officer on or before 27.11.2025 between 11:00 a.m. and 05:00 p.m. and in turn, the lnvestigating Officer is directed to follow the procedure laid down under Section 35 (3) of the BNSS (previously section 41-A ot Criminal Procedure Code, 1973) and also the guidelines formulated by the Hon'ble Supreme Court of lndia in Arnesh Kumar^y- Sfate of Biha/ scrupulously. However, the petitioner shall submit his defense and co-operate with the lnvestigating Officer as and when required by fumishing information and p(oduce all relevant documents/material required for the purpose
