The present Criminal Petition is filed seeking the Court to enlarge the petitioner who is arrayed as accused No.1 in Crime No.255 of 2024 before Yacharam Police Station, Rangareddy District, on bail.

The brief facts of the case are that on 22.08.2024, the Yacharam Police seized the contraband when the accused persons were buying and selling the contraband illegally to the general public in order to earn money in an easy manner. As such, the police registered a case against the petitioner and other accused vide Crime No.255 of 2024 before the Yacharam Police Station, Rachakonda, for the offences punishable under Section 8(c) read with 20(b)(ii)(C) of NDPS Act.

Learned counsel for the petitioner submitted that the petitioner is innocent and is are no way concerned with the alleged offences. He contended that the petitioner has been in judicial custody since 22.08.2024, causing undue hardship to his family. He asserted that the petitioner is resident of Alluri Sitharamaraju District, Andhra Pradesh State, with movable and immovable properties, is willing to furnish the sureties as directed. Therefore, while advocating that the material part of investigation is completed, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, stating that petitioner is involved in one other crime with the similar offence and the investigation in the case is not yet completed, therefore, prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions made and on going through the material placed on record, it is noted that no charge sheet is filed, and petitioner is in jail from 22.08.2024. Considering the period of incarceration of petitioner in jail, this Court deems it fit to grant bail to petitioner subject to the following conditions:

i. The petitioner shall execute a personal bond for a sum of Rs.25,000/(Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the XVI Additional Metropolitan Magistrate, at Ibrahimpatnam, Rangareddy District.

ii. The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 482(2) of BNSS (previously known as Section 437(3) of Cr.P.C.).

Accordingly, the Criminal petition is allowed.
