This Criminal Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) to direct the respondent to direct the respective branch managers of the bank to transfer Rs, 2,62,8001 (Rupees Two Lakh Sixty-Two Thousand Eight Hundred Only) to the petitioner's bank account. Alternatively, to direct the learned Xll Additional Chief Metropolitan Nlagistrate, Hyderabad, to number the Crl.M.P.Sr.No.BO72 of 2024 tiled on 15.07.2024 (Resubmission Sr.No.1659 of 2025) in Crime No. 2530 of 2023.

Heard Ms. Samhitha Devara, learned counsel for the petitioner and IVlr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent.

Learned counsel for the petitioner seeks a direction to the Xll Additional Chief Metropolitan Magistrate, Hyderabad, to number Crl.M.PSr.No.BO72 of 2024, filed on 15.07.2024 and resubmitted as Sr. No. 1659 of 2025 in Crime No. 2530 ol 2023, and to adjudicate the same in the interest of justice

The petitioner is the de facto complainant in Crime No 2530 of 2023, registered for offences under Sections 41.9 and 420 of lPC, and Sections 66(C) and 66(D) of the lT Act. He filed Crl.M.P.No.8072 ot 2024 seeking release of the amount seized during the investigation. However, the petition has not been numbered since 2024. lt was initially filed as Crl.M.P.No.B072 of 2024 and later resubmitted as Sr.No..l 659 of 2025. Therefore, the learned Xll Additional Chief Metropolitan Magistrate, Hyderabad, is directed to number the petition and decide it on its own merits, without being influenced by any observations made by this Court.
