CRIMINAL PETITION No.10434 of 2025

ORDER:

Seeking the Court to enlarge the petitioner who are arrayed as accused in Crime No.1210 of 2025 of Narsingi Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 69, 115(2) and 352 of the Bharatiya Nyaya Sanhita, 2023 (for short, ‘BNS’), on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 23.06.2025, the de-facto complainant lodged a complaint stating that in March 2022, she had posted on Facebook seeking a flat in Hyderabad. The accused, Ritwik Dutta, contacted her via Facebook and offered assistance. Trusting him, she moved to Hyderabad and gradually became friends with him. He invited her to stay at his flat in Kokapet, citing her lack of accommodation. In April 2022, he proposed a long-term relationship. She clarified that she was only interested in a relationship leading to marriage, to which he agreed. They began cohabiting and initiated a physical relationship based on his assurance of marriage. In May 2022, she shifted to a flat in 7 Hills with her mother. Initially, the

relationship was stable, but by December 2022, he began mentally and physically abusing her over trivial matters. She filed a police complaint, after which he promised to behave and reaffirmed his intent to marry her. In 2023, his parents invited her to Kolkata during Durga Puja and expressed support for the relationship. However, the accused continued to emotionally abuse her and avoided discussions about marriage. When she attempted to end the relationship, he threatened to circulate personal photos and videos. His parents persuaded her to continue the relationship. From 2023 to 2025, he repeatedly delayed marriage despite multiple assurances, including a promise made in front of her mother in March 2025. On 18.06.2025, he and his parents informed her that he would be relocating to Kolkata permanently and would not marry her. He also used abusive and vulgar language. She alleges that the accused misled her under the pretense of marriage, emotionally exploited her, and is now refusing to marry her despite longterm cohabitation and repeated promises.

Heard Sri Anirudh Nellikonda, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has not committed any offence, and that he has been falsely implicated in the present case. He further submitted that the petitioner was arrested on 24.06.2025, and that the material part of the investigation has been completed, including the examination of 11 witnesses. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner by contending that the allegations against the petitioner were serious in nature and that the investigation is in progress and if the petitioner is released on bail, at this stage, he may tamper with the evidence and may threaten the witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it is observed that the petitioner is in jail from 24.06.2025 and as the material part of the investigation is completed and considering the facts and circumstances of the case, this Court

deems it fit to grant bail to the petitioner subject to the following conditions:

i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XIII Judicial Magistrate of First Class, Ranga Reddy District at L.B. Nagar.

ii. The petitioner shall appear before the concerned SHO at 11:00 A.M., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
