without mentioning as to any specific reason has issued the impugned notices dt.04'03.2024 under section 185 0f the Terangana Municiparities Act, 2019 by ca,ing upon the petitioners to remove the stars which are erected by them for conducting their street vending activity within 24 hours from the date of receipt of the notices.

5' Petitioners further contend that the said notices have been served on the petitioners on 15.03.2024 by way of affixture; and that the respondenb-authorities, who are bestowed with the duty to identifi street vending zones, in total disregard to the provisions of the 2014 ACt, are resorting to evict the petitioners from the subject prace, whereat they have been permitted to carry out the street vending activity, thereby, not only violating the provisions of the 2014 Act, but also affecting the fundamentar right - 'Right to Live', guaranteed under Articre 2r of the Constitution of India, of the petitioners.

Per contr4learned Standing Counsel appearing on behalf of the 3d respondent has praced before this court the written instructions under the signature of the @mmissioner.

By the aforesaid written instructions, it is stated that the petitioners, who are carrying on the street vending activities, are encroaching on to the shoulders of Hyderabad-Karimnagar_Ramagundam road by erecting illegal temporary sheds and on account of the said

encroachment,^{the same} poses a significant^{risk of accidentsto} since the same^{affectsfree flow of trafficand} pedestrians and motorists, creates hazardous^{conditionsfor road users'}

S.Bythesaidwritteninstructions,itisalsoStatedthatthepetitioners inthenameofcarryingonthestreetVendingactivitybyencroachingon to the service^{roadare constructingthe buildings and compoundwalls} without any^{permissionfromthe MunicipalCorporation, and as such' the} authoritles^{haveissuedthe impugned show cause notices for removal of} the encroachments^{made on the shoulderof the road'}

While it^{is the caseof the petitionersthat they havebeen identified} as street vendors^{under the 2014 Act andissued with identitycards to} carry on the street^{vendingactivity and are carryingon the said activity} areentitledforprotectionunderthe2OL4Act,ontheotherhanditisthe case of the respondents^{that the petitioners claiming protection under the} 2014 Act are^{encroachingon the shoulderof the road and are making} construction^{therebycausing serious threat to the road usersof the} Hyderabad^{to Ramagundamvia Karimnagar'}

Be that^{as it may,since,the petitione6claim protection under the} provisionsofthe2ol4Actandalsotakingnoteofthefactthatthe petitioners aiE^{Elgrieved by the impugned proceedings issued by the3'd}

respondent authority, the petitioners can raise the grievance against the said proceedings, and seek redressal of their grievance by approaching the committee constituted under sub-section(1) of section 20 of the 2014 Act by making an application under sub-section (2) of section 20 thereof.

Since, the impugned notices as issued by the 3.d respondent authority, hardly gives any time to the petitioners to seek redressar of their grievance by approaching the concerned authority/committee constituted under the 2OL4 Act, this Court is of the view that the petitioners shourd be directed to avair the remedy provided under subsection (2) of section 20 0f the 2014 Actwithin a period of one week from the date of receipt of a copy of this order.

13' Upon the petitioners making an apprication raising their grievance with regard to the impugned proceedings as issued by the 3.d respondent authority, the speciar committee sha, adjudicate the same within a further period of two weeks therefrom, by taking note of the provisions of the 2014 Act and the protection that has been provided to the street vendors. l'ill such time the respondents-authorities take a decision on the application to be made by the petitioners under sub_section (2) of Section 20 0f the 2074 Act, the respondents-authorities sha, not give effect to the impugned proceedings.
