Regulation, the petitioner's contributionto CPF was paid to him on 27.O7.1993. The order of dismissalfrom service was parsed ot 26.06.1995, i.e., after nearlytwo years of attaining the age of superannuation. Thelearned counsel for the petitionerhad relied upon thejudgment ofthe Hon'bleSupremeCourt in the case of UCO Bank andOthers Vs' RajendraShankar Shukla (cited supral in support of his contentionthat such an order is ex-facie illegal and arbitrary.However, this Court frnds that the Hon'ble Apex Court in thecase of ChairmancumManaging Director, Mahanadi CoalFields Limited Vs.Sri Rabindranath Choubey3, inpara 10'23 of its order, has observed that the ratio of theabove decisionwas not that punishment of dismissal could nothave been imposed after superannuation, but theratio was that due to inordinatedelay in issuing the charge sheetand non-paymentof subsistence allowance during thependency of disciplinaryproceedingafter attaining the age of superannuation,the order of Dismissal from service cannot be sustained.Therefore,this argumentof the petitioner is not acceptable andis accordingly rejected' The next a-rgument of thepetition€r is that due to modifrcation of the
