Petitioner/A-9 has filed this petition seeking anticipatory bail in Cr.No.1 of 2024 of P.S. Vijayapuri Town, registered lor the offences under Sections 2O(b)(ii)(c) and 29 of NDPS Act r/w.34 IPC

Heard leamed counsel for petitioner and the learned Additional

Publ ic Prosecutor appearing for respondent-State.

The allegation against the petitioner is that he is the owner of crime vehicle bearing Registration No.MH-24-AU-8425, in which, 336 kgs of ganja ls being transported from Andhra Pradesh to Maharashtra.

Leamed counsel for petitioner submitted that the petitioner is

working as a Driver in RTC. Basing on the confession of A-1, the petitioner was implicated in the case, though he is not aware of transporting ganja in his vehicle. It is contended that since his Registration Certificate was with A-1, a false case has been foisted against him and that the crime vehicle is in the custody of Police when the alleged ganja was seized

The leamed Additionat Public Prosecutor opposed^the application stating that there is specific role ofthe^petitioner and he^is well aware about transporting^ganja in his^vehicle, and hence, petitioner is not entitled for anticipatory bail.

A perusal of the confession statement^{of A- I disclosesthatthe} petitioner is his brother and the owner of the^{crimevehicle and he has} informed the petitioner regarding^{the transportof ganja in the crime} vehicle, for which, he accepted.^{In view of the gravity of the offbnce,}

this Court is not inclined to^{grant anticipatory bail to the petitioner.}
