Learned Additional Public Prosecutor also submitted that the issue in the present criminal pe tition is covered by the earlier order in the above criminal petition.

4" Briefly, the allegations^{are that the petitiorrers,who} are teachers submitted^{false and fabricatertcertifi:ates and} th6reby got promotions. For the^{said rrlzlsorl ofthe} petitioners inducing the Sovernment^luthorityby furnishing talse and tlabricated^{certificat*' and securing} promotions, the complaints^{were Iiled'}

The petitioners were initially^{aRfointed,l;.fiecondar5r} Grade Teairers and while^{working as such,. iht:y passed} MA (Englishl, B.A from different^{Universities. On the basis} of their quaiifications, the^{petitioners were trclucled in tl.e} seniority lisr of Secondary^{Grade Teachersfit for} 1>romotion as School Assistant. After^{conductinspr'lmotronal} counseling, ;>ctitioners were^{promotedto tlt,: post of School} Assistant ir the year 2009 through^{varioL:s proceedings} after verific rtion of the certilicates sLrbrnrttr,,d by them.

However, the Director of School Education issued proeeedings ln Rc.No.9/D1-312Oo9, dated 23.O1.2010 instructing tJ:e District Educational Ollicers in the State to take action against the Teachers who produced fake certiEcates. On the basis of the said proceedings dated. 23.O1.2O10, show-cause notices were issued to tJre petitioners herein directing t}.em to submit their explanation regarding the genuinity oi the certificates produced by them.

The petitioners have questioned the impugned proceedings dated 23.O1.20 10 in the OAs as mentioned supra in the tabular form.

6 Ttre Andhra Pradesh Administrative Tribunal by ord dated. 16.08,2013 delivered by the Bench consisting of_Sri Justice Dr.G.Yethirajulu, Chairman and Sri M,V.P.C.Sastr5r,, Member, passed a common order in O.a.no.OZgg of 2OO9 and batch. AII these petitioners have preferred OAs as mentioned supra in the tabular form. T?re Bench of A.P.A.T framed point No. 1 in tJ e Common Order along with other points. Point No. I reads as follows:

In view rf the same, when the Tribunr;Ll^{has found} that the cer:ificates^produced by the^{petitior,ersare} genllrne, on he trasis of the instructions o( the officers of the Distri :1 Educational Officers, narrated aL^para No.71 of the rrder, criminal ofifences are t](]l- rnade oul.

Learned public prosecutor submits that there are several other issues which have to be investigated in the present cases regarding the validity of distance education, whether the Universities which gave certificates were recogn iz*d by tJle University Grants Commission, whether the applications while attending school can simultaneously attend for the examination, whether the certain teachers were promoted as Assistants, without even before receiuing degree certificates etc. The C.I.D investigation is not concemed with the said aspects. The only grievance against these pelitioners is that they have produced fake certilicates, which ultimately were found to be genuine.

The findings of the Tribunal that the certificates produced by the petitioners are genuine was on the basis of the information provided by the District Educational OIIicer.

All other aspects, as stated by the learned public Prosecutor are not criminal acts and they are related to administrative procedures.

In the said circumstances, the proceedings ag*nst these petitioners in the crimes mentioned in the table above, in,which they are arrayed ai accused are hereby quashed.
