Since, these^{Criminal Petitions are filed underSection} 482 of the^{Code ofCriminalProcedure, 1973' bythe} petitioners, who^{are arrayed as accused Nos'3 and 4 to quash} the proceedings^{against them in the very same C'C'No'836 of} 2o16onthefileoftheAddl.JudicialFirstClassMagistrateat Gajwel, they^{are being disposed of by this commonorder' The} offences alleged^{againstthem are punishableunder Sections} 42O,46A, 471,^{472 and 506 r/w 34 of the IndianPenalCode} (for short'the IPC).

Heard both the^{learned counselfor accused No'3 and} accused No.4,^{learnedAdditional Public Prosecutorfor the} respondent-State^{and perused the record'}

The case of respondent^{No'2 is that these accused and} five others^{have approachedhim offeringthe property for sale} to an extent^{of Ac.3.2OGts. It was representedthat the land} belongs to^{accused No.2.On the basis of the allegation that all} the accused^{Nos. 1 to 7 were carryingon real estate business}

and in the said process, an amount of Rs.5O,4g,0O0/_ was talen from respondent No.2, towards the consideration for the land and thereby cheated, the complaint was filed.

Since there are several incidents allegefl in the complaint and the statement of the de facto complainant that these petitioners along with others approached him and convinced him to purchase the property, this court is not inclined to quash the proceedings, even before the evidence is adduced by the de facto complainant.

Learned counsel for accused No.3 would submit that though there is a specilic allegation of taking amounts by accused Nos. l, 2, 4 to 7, however, no such specifrc allegation is leveled against accused No.3. The said defence can be agitated before the trial Court.

Accordingly, both the Criminal petitions are disposed off. In the event of the petitioners/accused Nos.3 and 4 filing an application under Section 205 of Cr.p.C., to be represented by a counsel, the same shall be considered by the Triat Court, by imposing conditions, without hindrance to the trial.
