Admittedly, the^parties had^{enteredinto Agreementof} Sale dated 24.09.2021 initially and^{thereafteranother} Agreement of Sale dated 01.02.2020^{was enteredwith art} arbitration clause. Clause^{17 of the aJoresaid Agreement} contains arbitration clause,^{which is extracted below for the} facility of reference.

That in case of ang dispute aises betwe.en the parties, both the parties will^{settle the issue with} amicable settlement betuteen^themutithout approaching to Court of laut^{uthich is bindingupon} the parties and be finaL."

Learned counsel for the^{applicantssubmits that the} dispute has arisen between^{the partiesaldtherea-fterthe} applicants got issued a^{legal notice to the respondents on} 14.08.2023 and respondent^{No.5 has issueda reply noticeto} the petitioners on 18.08.2023.

Therefore, learned counsel^{on either side would} submit that the arbitrator be^{appointedtoadjudicatethe} dispute between the parties. Learned^{counselfor both the} parties also submits that they have^{no objection in appointing} same arbitrator as was appointed^{inArb.Appln.No'130 of} 2024, as the issue is one and^{the same.}

A. Santosh Reddy, a former Judge of this Court (Resident of Plot No.46, H.No. 76-2-7 40 / 46, Kalyan Nagar, Gadcliannaram, New Malakpet, Hyderabad5o006o; Mobile No.9705053485), is appointed as an Arbitrator to adjudicate the disputes between the parties. The parties sha1l appear before the Arbitrator, along with a copy of this order. Further, the Arbitrator before entering upon the reference sha1l adjudicate the aforesaid issues as preliminary issues. However, the sole arbitrator shall proceed with the arbitral proceedings in accordance with 1aw.
