2 These applications are filed under Section 11(6) of the Arbitration and Conciliation Act, Lgg6 seeking appointment of an arbitrator to resolve the d.isputes between the parties.

Facts giving rise to filing of these applications briefly stated are that the respondent in Arbitration Application No.17O of 2024 is a developer, whereas the applicants are the owners of the land. The parties have entered into a Oe-retopmln? Agreement on 19.O4.2O2I.

Clause 30 of the a-foresaid agreement conti ns ar arbitration clause, which is extracted below for the facility of reference:

"The parties hereto agree to settle any difference or dispute arising out of this agreement through arbitrettion under the provisions of the Arbitration and ConciliaLiorL.Act of 1996 at Hyderabad."

The dispute between the parties has arisen. Therefore, the applicalts in Arbitration Application

No.170 of 2024 have invoked the arbitration cla.use and sent a notice under Section 21 of the aforesairl Act on

18.06.2024. The respondent has submitted a reply to the aJoresaid notice on 27.06.2024. Thereafter, the owners filed Arbitration Application No. I7O of 2A24. lt is also pertinent to note that the developer has z[so^hled Arbitration Application No.232 of 2024 seeking appointment of an arbitrator. Therefore , these

applications are taken up together.

.t Learned counsel for the parties joinfly submit that a sole arbitrator be appointed to adjudicate the dispute between the parties.

6 I have considered the submissions made on both sides.

The parties have entered into a development agreement which contains an arbitration clause. The dispute has arisen between the parties which requires { resolution in the manner agreed to by the parties. {

8 Therefore, Sri Justice A. Santosh Reddy, a former Judge of this Court (resident of plot No.46, H.No. t6-2-740/46 Kalyan Nagar, Gaddiannaram, New Malakpet, Hyderabad - 500060, Mobile No.97050534g5) is appointed as sole arbitrator to adjudicate the dispute between the parties.
