This Writ Petition is filed aggrieved by the order,^dated 15.12.2015, passed in O.A.No.1011 of 2014 by^{the Central} Administrative Tribunal, Hyderabad Bench,^{Hyderabad (for} short,'the Tribunal').

Heard the learned Deputy Solicitor^{General of India} appearing for the^petitioners and Ms.^{Anita Swain,learned} counsel appearing for respondent Nos.1 to^{16, 18, 20, 2L, 22,} 26, 27,30, 35, 37, 47 and 55,

Learned Deputy Solicitor General of^{Indiaappearing for} the petitioners had contended that^{the unofficial respondents} were working as Highly Skilled^{Grade-I with the petitionersand} they were claiming Modified^{AssuredCareer Progression(MACP)} Scheme benefits in the next^{promotional hierarchygrade pay'} Learned Deputy Solicitor General further^{contendedthat the} unofficial respondents are not entitled^{for grant of next} promotional hierarchy grade pay, but they are entitled to^next grade pay only, as per MACP Scheme. unofficial respondents was rejected for grant of MACP Scheme benefits in the next promotional hierarchy grade pay, the unofficial respondents have approached the Tribunal by filing the subject O.A. and the Tribunal vide impugned order, dated t5,t2.2O75, was pleased to allow the subject O.A. and directed the petitioners to grant the benefits of MACP Scheme to the unofficial respondents in the next promotional hierarchy grade pay instead of on the next grade pay.

Learned Deputy Solicitor General of India had further contended that the issue raised in the present Writ Petition is squarely covered by the judgment rendered by the Honourable Supreme Court in Union of India and others v. M.V. Mohanan Nairl, wherein the Honourable Supreme Court has held that the employees are entitled to the benefit of MACp Scheme only in the next grade pay but not in the next promotional grade pay, and that this Court also, in similar circumstances, allowed W.P.No,18516 of 20t7 and batch vide common order, dated 06.07.2023, by following the law laid down by the Honourable Supreme Court in M.V. Mohanan Nair's case (supra). Therefore, the present Writ Petition also deserves to be allowed by following the law laid down by the

Learned counsel appearing for respondent^Nos.1 to^16, 18,20,2L,22,26,27,30, 35, 37,47 and^{55 had contended} that the Tribunal has rightly allowed the^{subject O.A. in favour} of the unofficial respondents and directed^{the petitioners to pay} benefits under MACP Scheme in the next^{promotionalhierarchy} grade pay. Therefore, there are no merits in the Writ Petition and the same is liable to be dismissed.

This Court, having considered the rival^{submissionsmade} by the learned counsel for the^{parties, is of} the^{consideredview} that the issue raised in the^present Writ Petition^{is squarely} covered by the^judgment renilered by the^{HonourableSupreme} Court in M.V. Mohanan Nair's case^(supra)and that^{this Court} also, in similar circumstances, allowed^{W.P.No.18516of 2017} and batch, vide common order, dated 06.07.2023,^{by following} the law laid down by the Honourable Supreme Court^{in M.V.} Mohanan Nair's case^(supra). In view of the^{same, the} present Writ Petition also deserves to be allowed.
