Heard Sri Mallarapu Kiran Reddy, learned counsel for the petitioners, learned Government Pleader for Forests for respondent Nos.1 to 3.

lrarned counsel for the petitioners submit that more than 4O years back petitioners forefathers have occupied the subject Government land, situated in scheduled area, and brought the same for cultivation. After their death, petitioners have been in possession and doing agriculture and their names were entered in the revenue records i.e. pahanies and eking out their livelihood.

He further submitted that respondent No. 1 issued Notices alleging that ttre petitioners illegally occupied the forest land and directed them to appear and submit the explanation within one week. Pursuant to the said Notices, the petitioners have approached the respondent No. 1 and submitted all the

documents and rcqucsted him to drop the proceedings. But respondent No. I without passing any ordcr, trying to dispossess the petitioners from the subject laqds.

Per contra, learned Government Pleader submits that the total cxtcnt of land covered by Sy.No.al/ I is an extent of Ac.92 1.OO guntas and the same was notilied as Reserved [,-orest and the same was published in Gazette Notification Under Section l9 of Hyderabad Forest Act vide G.O.Ms.No.362 (Ag) dated 23.02.1960 and published in A.P. Gazette No.12 dated 13.03.196O. The petitioners have not produced any documents and thc petitioners are not in possession of the subject lands and they are not entitled any relief in the writ petitions.

7 . Having considered the rival submissions made by the respective parties, and perused the records. The specific contention of the petitioners is that their forefathers have occupied the Government land 40 years back, doing cultivation and eking out their livelihood and after their death the petitioners havc succeeded the same and they are in possession ol the subject lands. had issued notices invoking thc provisions of Section 2O of 'lelangana State F'orest Act, 1967 directing the petitioners to submit explanation and also documents within a period of one week or otherwise, he will take action against the petitioners.

Though the petitioners have pleaded in the affidavit stating that pursuant to the said impugned notices, they have approached the respondent No. I and submitted explanation with documents and rcquested them to drop the proceedings, but the petitioners have not enclosed copies of expianations along with thc writ petitions. The lcarned counsel for the petitioners requested the Court to grant libertlz to the petitioners to submit fresh explanation to the impugned notices and direct the respondent No.1 to consider the same and pass orders.

I . This Court while admitting the writ petitions, granted interim directions not to dispossess the petitioners from the subject lands except by following the due procedure by its order dated 13.08.2013, 14.08.2013 and 2a.O8.2O73 and the said interim orders are continuing till date.

[n view of foregoing rcasons, without going into other aspects of the matter, the writ petitions are disposed of permltting the petitioners to submit their explanations to the impugned notices dated 13.06.2009, 14.07.2OO9, L7.O9.2OO9, 13.06.2009, 14.O7.2OO9, 24.O7.3OO9 and 14.O7.2OO9 issued by the respondent No. 1, within a period of one month from the date of receipt of copy of this order, and on such explanation, the respondent No.1 is directed to consider the same and pass appropriate orders in accordance with law within a period of two months thereafter, after giving opportunity including personal hearing to the petilioners. Till such time, both the parties are directed to maintain status quo in respect of the subject property.

1 1. Accordingly, the writ petitions are disposed of. There shall be no order as to costs.
