It is the case of the petitioners that theyhavc rerired from service on different dates. Though theyare entitled for grant of incremenB, the respondents have not exended ro dlem on the ground that they have reti_red frcm service one day prior to their entitlemenr. Ffunce, they have submined represenrations requesrirlg Lhe respondens to extenci the benefit of incremenrs as if they were likel;. to retire on the date of their incremenr. But the respondenB have rejected their cases rtirls order dated 10.09.20i0. Aggrieved bythe same, rhe petirioners har.e approached the Tribunal by filir,g O.ANo.559 of 2C11 and the Tribunal uide order dated 2g.09.2012 dismissed the same on the ground of delay and [aches. Hence, the writ petirion.

Fh"i"g considered the rival submissions made by the leamed counsel on either side, this Coun is of the view that the representations submimed by the petitionen were rejected by the respondents uide order dated 10.9.2010. The petitioners have approachcd the Tribunal only in the year 2011, wllch would mean that the petitionen have rightly approached the Tribural well within the dme prescribed as per the Administrative Tribunals Act, 1985. Thereforc, the Tribunal^was not justified in dismissing the Ofu on thc ground of delay and laches. Funher, the petitioners are entitled^for i'ncrements which will have effect on their pensionary benefis and less pension will be^{receivcdevery month,} which will be a recurring cause o[ action to the
