As per the Service Regulations governing the respondents, the appellant was supposed to get relieved and report at newly transferred place within a period of 45 days from the date of issuing the transfer order. However, the respondents have not relieved the appellant within 45 days and finally, he was relieved after 45 days of the transfer order.pursuant to the relieving order, the appellant has joined in Khammam District on 05.08.1994 i.e. after expiry of 45 days from the date of transfer order. But, however, the respondents did not consider the case of the appeilant for fixing his seniority aueast from the date of his relieving i.e. from 37.07.L994. Learned counsel further contended that pursuant to the transfer order, dated 15.06.1994, the respondents have not relieved the appellant and as such, there was delay on the part of the respondents. in not rerieving the appeilant and For the delay on the part of the respondents, the appellant cannot be put to any loss. Therefore, the appeilant has submitted a detaired representation to the respondents to count his sen iority . aUeast from June, 1994 i.e. well within 45 days of the .transfer order, dated 15.06.1994.
