The present Motor Accident Civil Miscellaneous Appeal is filed challenging the order and decree, dated 2O.O7.2OOT in O.P.No.331 of 2OO4 on the frle of the Motor Accidents Claims Tribunal (IV Additional District Judge) (Fast Track Court), Nizamabad, (hereinafter referred to as "TribunalJ, the claimant/petitioner frled the present appeal, seeking enhancement of compensation.

The main grievance of tl.e appellant-claimant is that the Tribunal had not properly appreciated injuries certificate under Ex.A-3, wherein it is clearly mentioned that the claimant had two fractures and one simple injury. However, the Tribunal by treating all the injuries as simple injuries in nature; had not granted proper compensation and while granting compensation, the Tribunal has not awarded any compensation under various heads. The compensation awarded by the Tribunal is also meager and such compensation requires enhancement.

This Court by order dated 23.08.2023 directed the Regional Manager, New Indian Assurance Company Limited, Hyderabad Branch, to appear in person along with records in the present appeal. Since thc learned codnsel for the insurance company is

present, the^{appearance of the Regional Manageris dispensed} with. Learned counsel^{appearing for the insurance company} submits that the^{Tribunal has given findings basing on the} evidence on^{record; it shows that thereis no recordto support the} contents of^{Ex.A3. Therefore,the Tribunal has correctlyrejected} the claim of the injured^{and thereis no requirementto interfere in} the findings of^{the Tribunal.}

The evidence of^{P.W.2 and medical certificate issued under} Ex.A-3 shows that^{the injuriessufferedby the claimant are as} follows:

6.TheTribunalhasdiscardedtheclaimsoftheinjuredonlyon the ground that^{X-ray film was not hled'The fractures by} physical examination^{were not visible to the naked eyes'Hence'} all the fractures^{were appeared to be concealed fractures'} Therefore, determination^{musthave beenbased on the forensic} examination.TheTribunalhasacceptedEx.A3,howeverwithout ,iving^{any reason, discarded the contents of Ex'A3' Therefore' the}

evidence of the Tribunal in this regard is incorrect This Court believes the injuries sustained by the injured.

The Tribunal h as r. r a,, ro,.t D^ r ,.^^ , g anted Rs. l,OOO7 _ towards medical expenses and tr.rnsportation charges. The Tribunal has not granted any compensation towards attendant charges and extra nourishment. This Court TS inclined to grant a sum of Rs. IO,OOO/- towards medical expenses, transport charges, attendant charges and extra nourishment, which includes amounts already granted. The Tribunal by treating the injures as simple in nature has granted Rs. IO,OOO/_ towards pain and suffering. In the present case, the injured suffered fracture of right hip and both bones of right hand. This must have caused great amount of pain and suffering. Therefore, this Court is inclined to award a sum of Rs.2S,OOO/_ towards pain and suffering, which includes amounts already granted.

The Tribunal has not considered the temporary Ioss of earnings on account of injuries. Fractures of both bones of right hand and fracture of right hip, the injured must have taken some time to heal such fractures, and during said period, she must have deprived of eerrnings. The injured was agricurturist and she was aged about 30 years. The accident occurred in the year 2003. Considering the year of accident, minimum wages payable

to the agriculturist is Rs.3,SOO/-. The injured^{suffered multiple} fractures; this means it must takes six^(O6) months time^to recover from the injuries. Therefore, six months time is taken for calculating temporary loss of earnings of the injured. Therefore, this Court is inclined to award a sum of Rs.21,O0O/- (Rs.3500 x 6) towards loss of temporary earnings. The Tribunal has not awarded any compensation under loss of amenities, impact of such injuries on the reminder of life. Considering the injuries and nature of profession of injured, this Court is inclined to grant a sum of Rs.25,0OO/-.

The injured-appellant was granted an amount of

Rs. 11,OOO/- by the Tribunal towards compensation and the same is enhanced by Rs. 7O,OOO/- by this Court. The total quantum of compensation which the injured-appellant is entitled after the above enhancements comes to Rs.8 1,000/- [medical expenses, transport charges, attendant charges and extra nourishment Rs. IO,OOO/-⁺ pain and suffering : Rs.25,OOO/- + temporary loss of earnings : Rs.21,OOO/- + loss of amenities and impact of injuries on remainder of life: Rs.25,0OO/-1.

1O. In the result, the Motor Accident Civil Miscellaneous Appeal is partly allowed by enhancing the compensation amount awarded by the Tribunal from Rs, l1,OO0/- to Rs.8l,O0O/-. 'fhe enhanced
