This appeat is filed against the order dated, 0Z.06-20O7 in M.V.O.P.No. l9l5 of 2005 passed by the Chairman, Motor Accident Claims Tribunal-cum-Vl Additional District Judge, Warangal at Mahabubabad.

The appellant/petitioner has filed M.V.O.p.No. l9l5 of 2OO5 claiming compensation o[ an amount of Rs. 1,O0,OOO/_ for the injuries sustained in the motor accident and the trial Court has granted an amount of Rs.16,940/_ with interest at the rate of 7.5%o p.a., from the date of petition till the date of realization.

Aggrieved by the said order, this appeal is filed by the appellant/ petitioner and there is only dispute with regard to the quantum of compensation and the appellalt/petitioner has also examined PW.2/doctor, he stated as follows:

"PW.2 deposed that he is running the Hospital in the name of Laxmi Orthopedic Hospital and on 29.O4.2OO5 at 6.OO p.M. the petitioner came to his Hospital with the history of road traflic accident on 24.O4.2OO5 at 4.OOP.M. and on exemption he found the following injuries.

Contusion 6 X 8^{cms over right shoulder.}

Abrasion 8 X^1O cms^{overright foot.}

Fracture neck of right^{humeruswith greater} tuberocity fracture.

He dcposed that injuries^{iand 2 aresimple} and third injuries^{grievous in nature.He deposed} that PW. 1 went^{to traditionalbone setter before} coming to him and^{he appliedPOP. He admitted that} Exts.A-3 and A-5^{are issued by him and medicalbills} under Exs. A-6^{to A-8 as per his prescriptionPW'2} deposed about^{407odisability sustainedbythe} petitioner due to injuries."

The appellant/^{petitionerwas aged about 35 years on the} date of accident^{and doing agriculturework and earning} Rs.4,OOO/ - Per^month.

Considering^{the nature of the injuries, this Court is inclined} to grant Rs.3O,OOO/-^{for injuries, Rs' 10,000/- for medical} expenses, Rs.1O,OOO/-^{for pain and suffering, Rs' 1O'O00/- for loss} of earnings, Rs.lO,OOO/-^{for transportation,Rs'S,OOO/-for extra} nourishment and^{Rs.1O,Ooo/-for loss of amenities'}

Thereforc, the^{appellant/petitionerisentitledforthe} compensation^{in the followingterms:}

In the result, the appeal is partly allowed by enhancing the compensation from Rs. 16,940/- to Rs.8S,OOO/- (Rupees Eighty Five Thousand only) with interest at the rate of 7.syo p.a., from the date of petition till the date of realization. Respondent Nos. I to 3 are^jointly and severally liable to pay the compensation and respondent No.3 is directed to deposit the entire amount within a period of one month from the date of receipt of a copy of this judgment. On such deposit, the appellant/petitioner is entitled to withdraw the amount along with interest accrued on it. There shall be no order as to costs.
